1. Acceptance of Terms

By downloading, installing, or using the HadaBloom mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our App.

HadaBloom is a personal skincare tracking and analysis application that provides AI-powered insights, product recommendations, and skin health monitoring tools. These services are provided "as is" without warranties of any kind.

2. Use of Service

2.1 Eligibility

You must be at least 13 years old to use HadaBloom. If you are under 18, you must have parental or guardian consent to use the App.

2.2 Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

2.3 Prohibited Uses

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any malicious code or viruses
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the App or servers

  • Use automated systems to access the App

3. Medical Disclaimer

IMPORTANT: HadaBloom is not a medical device and should not be used for medical diagnosis or treatment.

The information provided by HadaBloom, including AI-generated insights, product recommendations, and skin analysis, is for informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician, dermatologist, or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the App.

If you think you may have a medical emergency, call your doctor or emergency services immediately.

4. Intellectual Property

4.1 Our Content

All content in the App, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of HadaBloom or its content suppliers and is protected by international copyright laws.

4.2 Your Content

You retain ownership of any content you submit to the App, including photos, logs, and notes ("User Content"). By submitting User Content, you grant HadaBloom a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving our services.

4.3 Feedback

Any feedback, suggestions, or ideas you provide about the App becomes the property of HadaBloom, and we may use such feedback without compensation to you.

5. Privacy and Data Protection

Your use of HadaBloom is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

We implement industry-standard security measures to protect your data, but no method of electronic transmission or storage is 100% secure. You acknowledge and accept this inherent risk.

6. Product Information and Recommendations

HadaBloom provides information about skincare products from our database of over 17,000 products. This information is gathered from various sources and while we strive for accuracy, we cannot guarantee that all product information is complete, accurate, or up-to-date.

Product recommendations are generated using AI algorithms based on your skin profile and logged data. These recommendations are suggestions only and should not replace professional skincare advice.

We may earn commissions from affiliate links to products, but this does not influence our recommendations, which are based solely on our algorithms and data analysis.

7. Subscription and Payments

7.1 Free and Premium Features

HadaBloom offers both free and premium features. Premium features require a subscription, which may be monthly or annual.

7.2 Billing

Subscriptions are billed through the App Store (iOS) or Google Play Store (Android). All billing and refund terms are governed by the respective store's terms and conditions.

7.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period.

8. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, HADABLOOM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL HADABLOOM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless HadaBloom, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last updated" date.

Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the App will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in San Francisco, California.

You waive any right to a jury trial or to participate in a class action lawsuit.

14. Severability

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HadaBloom regarding the use of the App and supersede all prior agreements and understandings.
